DMCA PROVISIONS

The Digital Millennium Copyright Act of 1998, found at 17 U.S.C. § 512 ("DMCA"), provides recourse for owners of copyrighted materials who believe that their rights under United States copyright law have been infringed upon on the Internet. Under the DMCA, the bona fide owner of copyrighted materials who has a good faith belief that their copyright has been infringed may contact not only the person or entity infringing on their copyright, but may also contact the designated agent of an Internet Service Provider ("ISP") to report alleged infringements of their protected works, when such alleged infringements appear on pages contained within the system of the Internet Service Provider.

The owner of this website and the ISP are committed to complying with international trade law, international trade practices, all United States laws, including United States copyright law. Upon receipt of a properly filed complaint under the DMCA, the owner and/or the ISP of this website will block access to the allegedly infringing material. The website owner and/or the ISP will forward a copy of the notification of claimed copyright infringement to the alleged infringer. Please use the subject line as given above. We receive many emails daily and this will help us to promptly take appropriate action.

Using Section Numbers as shown below, provide the requested information:

1. Identify in appropriate detail the copyrighted work you believe that has been infringed upon.
(A word description. Include an attached image to the email if one is available.)

2. Specifically identify the material you claim is infringing upon the copyrighted work listed in item #1 above.
(Must include the full URL(s) of the web page(s) location containing the allegedly infringing material.)
(Also include a description of the specific content which you claim is infringing on your copyright.)
(Reference any included image if one is attached, as applicable.)

3. Provide information reasonably sufficient to permit the website owner to contact you if needed for any clarification.
(Email address and phone number are required at a minimum.)

4. Include the following statement: (Mandatory)

"I swear, under penalty of perjury, the information in this notification is accurate and I am the copyright owner or an authorized agent to act on behalf of the owner of an exclusive right that is allegedly infringed. I also affirm as the copyright owner, I have a good faith belief that use of the material in the manner complained of is not authorized by me, my agent, or the law."

5. Signature. It is mandatory to provide the signature of the copyright owner or a person authorized to act on behalf of the copyright owner. Sending your notice via email requires such notice to include a proper electronic signature. The signature or electronic signature must be that of the copyright owner, or a person authorized to act on behalf of the owner of an exclusive copyright that has allegedly been infringed. An acceptable signature may be a signature image file, a valid .VCF file, or use of the S-signature format. For example, a S-signature is as below and is legally binding:

The above is the minimum requirements to notify MyTeeFunny.com of any claims regarding alleged copyright infringement(s). For details on the information required for valid notification per the DCMA, see 17 U.S.C. § 512(c)(3).

COUNTER NOTIFICATION TO CLAIMED COPYRIGHT INFRINGEMENT

If a notice of copyright infringement has been received by the website owner and/or the ISP, the website owner and/or ISP will attempt to notify you and provide you with a copy of the action taken in regards to the claim of copyright infringement. If the website owner and/or ISP have a good faith belief that they have been wrongfully accused, they may file a counter-notification with you or your designated agent. The DMCA provides that the removed or blocked information may be restored, allowing the website owner and/or the ISP to replace the removed material and cease disabling access to it in not less than 10, nor more than 14 business days following your receipt of the counter-notification, unless the website owner and/or ISP first receives notice from the complaining party (you) that an action has been filed seeking a court order to restrain the alleged infringer (website owner and/or ISP) from engaging in infringing activity relating to the material on this website.
